INTRODUCTION

For purposes of these General Terms and Conditions and elsewhere on the website, “WAZ Outdoor” means WAZ Outdoor (Proprietary) Limited, Reg nr: 2017/077492/07. WAZ Outdoor’s head office is located at Morning Mist, Southern Cross Drive, Constantia, 7806, Cape Town, South Africa; e-mail address: info@wazoutdoor.com, telephone: +27 (0) 82 4455 7981.

WAZ Outdoor specialises in the design, manufacture, marketing and selling of luxury Outdoor Furniture and related accessories.

APPLICATION

These General Terms and Conditions will apply to any and all agreements and legal relations pursuant to which WAZ Outdoor acts as supplier of items.

PRICE AND PAYMENT

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Products sold by WAZ Outdoor are billed in South African Rands.

Payment is accepted via credit card (Visa or Mastercard) and direct transfer. Online credit card transactions will be acquired for WAZ Outdoor via Paygate (Proprietary) Limited (“Paygate”). Paygate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to their website, https://www.paygate.co.za to view their security certificate and security policy. Customer details will be stored by WAZ Outdoor seperately from card details which are entered by the client on DPO Paygate’s secure site. For more detail on DPO Paygate refer to www.paygate.co.za

WAZ Outdoor shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).

WAZ Outdoor will, at all times do our utmost best to ensure that the price given to you is accurate, but the price of your order will need to be validated by WAZ Outdoor as part of our acceptance procedure. If the price for the order changes before we accept your order, we will contact you and ask you to confirm whether you wish to proceed at the amended price.

COSTS OF DELIVERING THE FURNITURE

All prices posted on the website are exclusive of delivery costs.

DELIVERY AND DELIVERY PERIOD

WAZ Outdoor shall endeavour to supply the items ordered, provided that WAZ Outdoor has the selected fabric available, to the delivery address within 6-8 weeks of the order confirmation and the required receipt of payment.

WAZ Outdoor will let you know if we are unable to meet our estimated delivery date, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

On delivery of the product, you will be required to sign for delivery. You agree to inspect the Product for any obvious faults, defects or damage before you sign for delivery.

You are to report any defects in writing, with photographic evidence to WAZ Outdoor within 3 days.

AGREEMENT OF SALE

Placing an item in a shopping cart without completing the purchase cycle, does not constitute an agreement of sale between WAZ Outdoor and the purchaser. Users cannot hold WAZ Outdoor liable if such items are not available when the purchase cycle is completed; and WAZ Outdoor may remove such an item from the shopping cart if no stock is available. An agreement of sale between WAZ Outdoor and a user only comes into effect if and when a credit card authorisation is received from the issuing bank.

RETURNS POLICY

Products may not be returned unless the incorrect product has been supplied or the product is damaged upon delivery. In such an instance WAZ Outdoor will exchange the product on condition that:

-the product is returned in its original condition

-the customer returns the product within ten working days of receipt and confirms same by sending a written notice to info@wazoutdoor.com (within a three day period).

-All returns must be communicated and confirmed with WAZ Customer Services prior to shipment, to ensure the product is correctly ‘flat-packed’ (no bead filling) and the correct economy courier service is contracted. Without this, WAZ will not be held liable for any courier costs.  The onus is on the customer to ensure that the goods returned are received by WAZ Outdoor within 10 working days.

Once we have inspected the product and validated your claim, we will repair/replace the product as quickly as possible. If we are unable to repair or replace the product, we will refund you with the purchase price of the product and handling cost.What constitutes a defect? Any material imperfection in the manufacture of a product or any characteristic of a product which makes the product less acceptable than one would reasonably be entitled to expect in the circumstances.The following will NOT be regarded as defects and will not entitle you to a return:

-faults resulting from normal wear and tear

-damage arising from negligence, user abuse or incorrect usage of the product

-damage arising from a failure to adequately care and maintain the product

-damage arising from unauthorised alterations to the product

Should your product be custom made for your decorating specifications, there will be no refund, should you wish to cancel your order. For ready-made orders, there will be a 10% cancellation fee to cover any administration costs as well as any courier fees incurred.

STANDARD WARRANTY POLICY

WAZ Outdoor provides a 1 Year warranty on all products sold on its website against defects or poor quality from the date of delivery, and a 2 year guarantee for fabric strength and colour.

Products which have been personalised for you or made to your specifications,  cannot be exchanged, unless they are damaged or not as described.9.

APPLICABLE LAW

This site is hosted, controlled and operated from the Republic of South Africa and therefore governed by South African law.

CHANGES TO AGREEMENT

WAZ Outdoor may, at its sole discretion, change this agreement or any part thereof at any time without notice. It is your responsibility to regularly check these Terms and Conditions and make sure that you are satisfied with the changes

INTELLECTUAL PROPERTY RIGHTS

All the content, trademarks and data on this web site, including but not limited to, software, databases, text, graphics, icons, hyperlinks, private information, designs and agreements, are the property of or licensed to WAZ Outdoor and as such are protected from infringement by local and international legislation and treaties.

DOMICILIUM

WAZ Outdoor chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature: Morning Mist, Southern Cross Drive, Constantia, 7806, Cape Town, South Africa.
